1. Definitions

2. Scope of Services

2.1 We provide rubbish clearance and waste collection services at residential and commercial premises within our operating area. The precise services to be provided will be agreed at the time of Booking or during an on-site assessment.

2.2 Unless expressly agreed in writing, our Services are limited to the loading, removal, transport and disposal of Waste that is lawfully acceptable at licensed waste facilities. We do not provide building, plumbing, electrical or other specialist services.

2.3 We reserve the right to refuse to remove any items that we reasonably believe to be hazardous, illegal, improperly described, or unsafe to handle or transport.

3. Booking Process

3.1 You may request a Booking by contacting us via telephone, email or any other communication channel we make available. When you provide details of your waste collection requirements, we may offer an initial estimate based on the information you supply.

3.2 Any estimate given before our team attends the premises is indicative only and not binding. The final price will be confirmed on site once we have inspected the Waste, assessed access and loading conditions, and confirmed the volume, weight and nature of materials to be removed.

3.3 A Booking is only confirmed when we have agreed a date and time window with you, and you have accepted any applicable pricing information or minimum charge that we have communicated.

3.4 You are responsible for ensuring that all information provided to us in relation to the Booking, including the description of the Waste, the address, access details, and contact information, is complete and accurate.

3.5 We may ask for photographic or written confirmation of the Waste and access conditions prior to confirming a Booking, in order to give a more accurate estimate and ensure the correct resources are allocated.

4. Access and Customer Responsibilities

4.1 You must ensure that we have safe, timely and reasonable access to the premises and to the Waste to be collected. This includes arranging any required permissions, parking, building access, keys, gate codes or lift use in advance of our arrival.

4.2 You agree to clearly identify the Waste to be removed and to ensure that no items intended to be retained are mixed with those to be collected. We accept no liability for removing items that you or your representatives have failed to separate or label clearly.

4.3 Where access to the premises is restricted or unsafe, or where the Waste is not as described at the time of Booking, we may either revise the price, refuse part of the load, or cancel the Booking. In such cases, a call-out or cancellation charge may apply as set out in these Terms.

4.4 You are responsible for ensuring that children, pets and any vulnerable persons are kept clear of working areas during the provision of the Services, to maintain safety for all parties.

5. Pricing and Payment

5.1 Our charges are generally based on the volume, weight and type of Waste collected, as well as labour time, access conditions and any additional services agreed. We may operate a minimum charge for small collections.

5.2 All prices are quoted in pounds sterling and, unless stated otherwise, are inclusive of applicable taxes, including VAT where relevant.

5.3 The final price for your collection will be confirmed by our team on site before any Waste is loaded. If you agree to the quoted price, we will proceed with the Service. If you do not agree, we may apply a call-out or assessment fee to cover our attendance costs.

5.4 Payment is due in full upon completion of the Service, unless otherwise agreed in writing in advance. We may accept payment by cash, card or other methods that we specify from time to time.

5.5 For business customers or account holders, payment terms will be as agreed separately in writing. If you fail to pay any amount due by the agreed due date, we reserve the right to charge interest and late payment fees in accordance with applicable UK law.

5.6 We reserve the right to change our prices at any time. However, price changes will not affect a confirmed Booking where we have already provided a final on-site quotation and commenced the Service, unless additional Waste or services are requested.

6. Cancellations and Amendments

6.1 If you wish to cancel or amend a Booking, you must notify us as soon as possible by telephone or email, quoting your Booking details.

6.2 If you cancel a Booking more than 24 hours before the agreed arrival time, no cancellation fee will normally be charged.

6.3 If you cancel within 24 hours of the agreed arrival time, we may charge a cancellation fee to cover our administrative and scheduling costs.

6.4 If our team arrives at the premises at the agreed time and is unable to gain access, or if the Waste is not available for collection, or if you no longer wish to proceed once we have arrived, we reserve the right to charge a call-out fee or apply our minimum charge.

6.5 We will use reasonable efforts to attend your premises at the agreed time, but all times are estimates and not guaranteed. We are not liable for any loss or inconvenience caused by delays due to traffic, weather, operational issues or other matters beyond our reasonable control.

6.6 We reserve the right to cancel or reschedule a Booking in the event of operational difficulties, staff illness, unsafe conditions, or circumstances beyond our control. In such cases we will seek to contact you as soon as reasonably practicable to arrange an alternative appointment.

7. Waste Types and Regulations

7.1 We operate in compliance with relevant UK waste management laws and regulations, including the duty of care for the handling, transport and disposal of controlled waste.

7.2 We will only collect Waste that we are legally permitted and equipped to handle. Hazardous waste, including but not limited to asbestos, chemicals, solvents, oils, clinical waste, gas bottles, and certain electrical items, may be subject to additional restrictions, charges or refusal.

7.3 You are responsible for informing us in advance of any hazardous or unusual materials present in the Waste. If hazardous waste is discovered on site that was not disclosed at the time of Booking, we may refuse to remove it and may charge for our attendance.

7.4 We will transport collected Waste to licensed disposal or recycling facilities, and we will use reasonable efforts to maximise recycling and recovery where practicable.

7.5 Where required by law or requested by business customers, we may issue a waste transfer note or other documentation indicating the nature, quantity and destination of the Waste.

8. Customer Property and Site Condition

8.1 We will take reasonable care when carrying out the Services to avoid damage to your property. However, you acknowledge that the removal of bulky items, the movement of Waste from difficult locations, or clearance of heavily cluttered spaces may carry a risk of minor damage.

8.2 You must inform our team of any fragile areas, hidden services, weak structures, or special access issues before work begins. We are not responsible for damage that could not reasonably have been foreseen or that arises from undisclosed risks.

8.3 We do not undertake to clean or make good any areas from which Waste has been removed, other than basic sweeping of accessible areas where reasonably practicable. Comprehensive cleaning, repairs or decorating are not included within the scope of our Services unless expressly agreed in writing.

9. Liability and Limitations

9.1 Nothing in these Terms and Conditions limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded under UK law.

9.2 Subject to clause 9.1, we shall not be liable for any indirect, consequential or special loss, including loss of profit, loss of business, loss of opportunity, loss of data or any similar losses arising out of or in connection with the Services.

9.3 Our total liability for any claim arising out of or in connection with the Services, whether in contract, tort or otherwise, shall be limited to the total amount paid or payable by you for the specific Service giving rise to the claim.

9.4 We shall not be liable for any delay or failure to perform our obligations where such delay or failure results from events, circumstances or causes beyond our reasonable control, including but not limited to severe weather, traffic incidents, accidents, breakdowns, strikes, or acts of government or regulatory authorities.

9.5 You are responsible for securing or removing any valuable or delicate items in areas where we will be working. We accept no liability for loss of or damage to items that were not clearly identified or that were left in or on Waste intended for removal.

10. Insurance

10.1 We maintain appropriate insurance cover for our operations, including public liability cover, in line with industry standards.

10.2 Details of our insurance policies can be provided on request. Any claim that you wish to make in relation to alleged damage must be notified to us in writing as soon as possible and in any event within 7 days of the Service date, providing reasonable details and evidence.

11. Complaints

11.1 If you are unhappy with any aspect of our Services, you should contact us as soon as possible, providing your Booking details and a clear description of the issue.

11.2 We will investigate complaints in a fair and timely manner and, where a complaint is upheld, we may offer to re-attend, provide a partial refund, or take other appropriate remedial steps at our discretion.

12. Personal Data

12.1 We may collect and process personal data about you in connection with your enquiry, Booking and the provision of our Services.

12.2 We will handle personal data in accordance with applicable UK data protection laws and use it only for purposes connected with the management of our waste collection services, administration, customer service, and legal or regulatory compliance.

13. Variation of Terms

13.1 We reserve the right to update or amend these Terms and Conditions from time to time. Any changes will take effect when published or otherwise communicated to you.

13.2 The version of the Terms and Conditions in force at the time of your Booking will apply to that Booking, unless a change is required by law or regulatory authority.

14. Severability

14.1 If any provision or part-provision of these Terms and Conditions is found to be invalid, unlawful or unenforceable, it shall be deemed modified to the minimum extent necessary to make it valid, lawful and enforceable.

14.2 If such modification is not possible, the relevant provision or part-provision shall be deemed deleted. Any such modification or deletion shall not affect the validity and enforceability of the remaining provisions.

15. Governing Law and Jurisdiction

15.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or their subject matter or formation, shall be governed by and construed in accordance with the law of England and Wales.

15.2 You and we agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the Services.

16. Entire Agreement

16.1 These Terms and Conditions set out the entire agreement between you and us in relation to the provision of rubbish clearance and waste collection services and supersede any previous agreements, understandings or arrangements, whether written or oral.

16.2 You acknowledge that you have not relied on any statement, promise or representation that is not set out in these Terms and Conditions when entering into a contract with us.
